The Greenlist Website has been designed to provide End Users with a place to find and compare products and services’ (hereafter referred to as Products) sustainability qualities.
Suppliers of Products are asked to answer a series of questions as accurately as possible. The Website then calculates and displays the sustainability icons together with the relevant Products’ listing. Suppliers can also indicate a number of third party certifications. We request that Suppliers keep all the information provided by them as current as possible.
End Users are offered an opportunity to comment at the bottom of each listing and are requested to provide relevant information that enables other End Users to gather additional information regarding products and services. In an attempt to keep comments appropriate, to eliminate spam and to avoid any defamation issues, End Users are only able to provide comments once they have provided and verified their e-mail details.
Greenlist does not endorse or audit any of the Products listed. End Users acknowledge and agree that they arrive at any conclusion or decision by relying on their own judgement and may make purchasing decisions based upon their own interpretation of the information on the Website and form their own conclusions.
At no time will Greenlist, its directors, shareholders or any related company, person or organisation be liable for any reliance placed upon the sustainability icons, information, or any comments listed on the Website regarding any Products.

Definitions |
| 1.1 |
In these terms and conditions:
End Users or you mean the individuals (whether for their personal use or on behalf of an organisation) that access’ the Website and/or use the information posted on the Website;
Feedback means comments, remarks, observations, endorsements or criticisms (hereafter referred to as Comments) about any Products listed on the Website made by the End Users in the designated area provided for Comments, on the Website.
Greenlist and we, our or us mean Sustainable Business Network Incorporated and Ecobob Limited trading as Greenlist and are the owners of the Website;
Products mean any products and services listed on the Website from time to time;
Registration Process means the process whereby Suppliers request to list Products on the Website by providing information to us on-line and by paying a listing fee on-line and our subsequent approval of them (in our sole discretion) as a Supplier;
Services mean any service offered by us from time to time including listing any Supplier’s Products on the Website;
Supplier or Suppliers mean the organisation (and where relevant, the individuals) that completes the Registration Process and once approved, supplies the Products listed on the Website from time to time;
Terms and Conditions means these Terms and Conditions;

Terms & Conditions |

By accessing and using the Website you are deemed to have accepted Greenlist’s Terms and Conditions for End Users current at the time (i.e. as amended from time to time). If you do not accept any of the Terms and Conditions, you should not access, search, use or obtain information listed on the Website or use the Services. |

Channel Only |
| 3.1 |
We channel information received from Suppliers on the Website for End Users to access. End Users cannot purchase Products by using the Website. We do not take any part in any transaction facilitated as a result of the findings on or through the Website. You acknowledge and agree that Greenlist shall not be liable for any actions of the End Users or of any other Supplier. |
| 3.2 |
We do not act as an agent for either the Supplier or the End Users. |
| 3.3 |
You acknowledge and agree that Greenlist has no responsibility or liability for any misconduct of any Supplier and End Users including, without limitation, any individual or organisation that have registered under false pretences or provides information that is incorrect or misleading in any way. |
| 4. |
Listings |
| 4.1 |
The Suppliers warrant that they are entitled to and have every right relevant to their listing of the Products. |
| 4.2 |
We may provide the recommended retail prices of any or all of the Products listed, and if we do, all prices shown on the Website will be in New Zealand Dollars and inclusive of Goods and Services Tax. |
| 5. |
Information about Products |
| 5.1 |
Greenlist has requested that Suppliers provide the most up to date and correct information on the Website; however we do not guarantee that the information will be current or accurate at any time.
Greenlist request and the Suppliers agree to meet the Commerce Commission’s Green Marketing Guidelines to ensure compliance with the Fair Trading Act; View guidelines here. However we do not guarantee that the information will meet or comply at any time. Please contact us if you notice anything that you think does not meet these guidelines or comply.

You acknowledge that because we do not endorse the Products listed on the Website, you arrive at your own decision regarding Products and information contained on the Website and do not rely on any statement or representation made by us. |

By using the Website and the Services you are deemed to have accepted and agreed that Greenlist have the right to use any or all of the information provided, in our sole discretion. |

Feedback, & Comments |

If you would like to Comment on any of the Products listed on the Website, you may do so by entering and verifying your e-mail details and providing the Anti-Spam information requested, at the designated area for Feedback under each listing of each Product. |

The following rules apply to the Feedback: |

a) No swear words, undesirable language, offensive, incorrect, potentially misleading or defamatory Comments will be accepted; |

b) No reference will be accepted to other, alternative or substitute products or services, other than those Products listed on the Website; |

c) Greenlist reserves the right to decide in its sole discretion whether or not to post any Comment on the Website and therefore does not guarantee that any Comment will be listed on the Website. |

You acknowledge that our aim is for the Website and system to self-regulate and that we do not have any obligation to investigate any information provided regarding any Products nor is it our policy or do we have an obligation to investigate any complaints; but that we may, at our sole discretion, take up any complaints that we receive if we consider it, in our sole discretion, to be serious, relevant or potentially harmful to the credibility of the Website or our reputation. |

Liability & Indemnity |

To the fullest extent permitted to by law, Greenlist shall not be liable for any loss or damage (whether direct or indirect) incurred as a result of the Products, Services and information contained on the Website, including loss or damage from any mis-description or mistake or as it relates to any Comment made by End Users by way of Feedback or otherwise. |

End Users hereby indemnifies and will hold harmless Greenlist against and release us from all actions, demands, claims, fines, taxation, damages, losses, costs (including legal fees on a full client solicitor basis) and any other liability whatsoever arising out of our channelling of information or under these Terms and Conditions. |

Changes to Website Content |

Greenlist reserves the right to make change to any information on the Website, at any time without prior notice. |
| 9. |
End Users & Consumer Legislation |
| 9.1 |
You agree that all End Users’ purchase and service enquiries, including enquiries regarding related products will be dealt with directly by you with the Suppliers. |
| 9.2 |
For the avoidance of doubt, in the event than an issue arises as a result of any information that any End Users obtained by using the information on the Website, such issue will be dealt with directly between the End Users and the Suppliers. |
| 10. |
Information |
| 10.1 |
Greenlist collects information from you directly when you wish to add Feedback. This may include you indicating that they wish to be placed on our email lists. |
| 10.2 |
All information will be collected and held in accordance with the provisions of the Privacy Act 1993. You may access or request changes be made to the information that we hold about you by emailing a request to info@greenlist.co.nz. You may ask to be removed from Greenlist’s email lists at any time. |

We are happy to discuss any concerns that you may have in providing the information that we require. |
| 11. |
New Zealand Courts & Disputes |
| 11.1 |
These Terms and Conditions shall be governed by the laws of New Zealand and you hereby submit to the non-exclusive jurisdiction of the Courts of New Zealand. |

Any disputes arising as a result of the Website will initially be dealt with through Mediation. |
| 11.3 |
Nothing prevents any party from approaching the Courts of New Zealand for injunctive relief. |
